Triple Talaq in any form - spoken or written - will send husband in jail for 3 years

New Delhi : The government is all set to bring a bill in upcoming Winter Session of the Parliament that will send a husband in jail for up to three years who will attempt triple talaq.

Apart from jail, the man will also be charged with a fine if he tries to go for instant triple talaq in any form — spoken, written or communicated through electronic means like instant messages and emails.

The offence has been kept non-bailable.

Talaq-e-biddat is a custom under Muslim personal law that allows a man to divorce his wife by uttering the word “talaq” thrice. The practise was struck down by Supreme Court on August 22 and directed Centre to form a new law over this.

As the law stands today, a victim of ‘talaq-e-biddat’ or instant triple talaq would have no option but to approach the police for redressal of her grievance as a Muslim clergy would be of no assistance to her.
