New Delhi : Delhi Police raided across various places in Delhi-NCR upon the complaint of software giant Microsoft. As per the available information, the FIR is not uploaded on the website of Delhi Police, which in itself is the violation of the Delhi High Court Judgment and calls for the contempt of court from the side of Delhi High Court on Commissioner of Police.

There are glaring illegalities committed by the Delhi Police, especially for infringing the human rights of the citizens, as without having any relevant piece of evidence nearly 48 persons have been arrested.

Till now 32 call centers have been raided through the length and breadth of the Delhi and NCR, including Gurgaon and Noida. Furthermore, by reading the FIR it becomes pretty clear that only the civil liability is made out under the Trademark & Copyright Act and no ingredients are satisfied under the offences, as stated under the Indian Penal Code 1860.

Cyber Law Expert & Trademark & Copyright Lawyer Advocate Himanshu Raj, while going through the FIR, said that not even a single offence is attracted as far as the Indian Penal Code 1860 is concerned. It is purely a civil liability and the police have registered an FIR merely on the basis of suspicion and are making a fishing/roving enquiry. The same is forbidden by Supreme Court Of India in a catena of cases. 

Also, The Supreme Court has time and again stated in a number of cases that fishing and roving enquiries can't be taken up by the police. The said action reminds us of the time of draconian law like Terrorist & Disruptive (Prevention)Act (TADA).

In the recent past, it has been observed that in such cases The National Human Rights Commission also swings into action. It is high time to introspect for Delhi Police so as to avoid the atrocities committed by the lower staff of Delhi Police.
