Decade-old hate speech case against Yogi Adityanath returns
Lucknow : Supreme Court asked Gorakhpur Court to decide afresh on whether it wants to take up decade-old hate speech case against Uttar Pradesh Chief Minister Yogi Adityanath.
The apex body also directed them to come with a detailed judgement in either situation of taking or not taking the case.
In 2007, Yogi Adityanath, then BJP's Hindutva Mascot' was accused of making hate speeches in Gorakhpur while he represented Lok Sabha.
A police case, followed by a chargesheet was also filed against Yogi Adityanath in the matter.
The police told court they had the necessary permission from the government to prosecute all accused under Section 153A of the Indian Penal Code but a superior court in Gorakhpur later agreed with the contention of the accused that the permission to prosecute was not given under due procedure.
In February, High Court upheld the case claiming that it cannot take cognizance of charges except with the approval of the central or the state government. But the high court's decision was challenged in the top court.
