Supreme Court rejects plea to stay bail for ex RJD MLA Shahabuddin

New Delhi : The Supreme Court on Monday rejected a plea to stay bail granted to former RJD MLA Shahabuddin, instead issued a notice asking him to appear before the court on a plea challenging bail given to him in a murder case.

The apex court rejected the plea saying it wants to hear from Shahabuddin also. September 26 has been fixed as the next date of hearing.

Pleas challenging bail were filed by both the Bihar government and Siwan native Chandrakeshwar Prasad who says three of his sons were allegedly murdered by Shahabuddin.

# SC on Monday rejected plea questioning bail granted to former RJD MLA and criminal convict Shahabuddin.

# The plea told Supreme Court that Patna High Court has committed a mistake by granting bail to Shahabuddin.

# Chandrakeshwar's lawyer Prashant Bhushan said free and fair trial wouldn't be possible if Shahabuddin remains out from jail.

# "Witnesses won't depose against Shahabuddin out of fear," Bhushan told the Supreme Court.

# Patna High Court had granted Shahabuddin bail on September 7 in the 2014 murder case of Chandrakeshwar Prasad's son Rajiv Roshan.

# Shahabuddin had stepped out from jail on September 10.

# The trial for Rajiv Roshan’s case is yet to begin.
